The initiative specifically targets exchanges permitting retail clients to trade digital assets via leverage, margin, or financing, and follows the failure of Congress to pass broader market-structure legislation for the cryptocurrency sector.
This initiative offers qualifying platforms an alternative to the existing landscape, where digital asset companies must navigate varying mandates across different states. The CFTC stated that implementing a federal framework could establish enhanced regulatory clarity alongside enhanced protections for markets and consumers.
CFTC Proposes New ‘Crypto Asset Market’ Category
The agency’s plan introduces a novel classification of federally overseen trading platforms designated as ‘crypto asset markets’. Exchanges providing retail users with margined or leveraged spot cryptocurrency products will have the option to register within this structure, thereby functioning under a unified set of federal standards.
This prospective system addresses retail commodity trades involving digital assets that already fall under the agency’s current statutory jurisdiction. Nevertheless, the CFTC noted that congressional intervention would be necessary to mandate that all spot crypto trading transition exclusively to CFTC-approved venues.
New Requirements for Crypto Exchanges
Exchanges that choose to participate in this regime will be subject to heightened duties designed to safeguard users and bolster market stability. These mandates encompass measures to prevent market manipulation alongside obligations for proof-of-reserves.
Additionally, the CFTC suggests routing customer transactions on these approved crypto markets through registered futures commission merchants. The commission explained that the strategy seeks to set transparent guidelines proactively rather than depending heavily on retroactive enforcement after infractions take place.

The commission is currently accepting public feedback for a period of 60 days following its publication in the Federal Register, with this input guiding decisions on whether and how the framework advances toward official rules.
