Petsmart is one of a handful of stores that sell pet supplies that sell plastic bags. Just because you buy a bag of food does not mean you are breaking the law. Your dog or cat can’t just walk into your house and buy everything in the bag.
This is the latest piece of legislation that has been proposed to make it illegal for pet shops to sell plastic bags. If passed, if you do happen to drop by a pet shop, we’d like to ask you to please stop by the store with your dog or cat.
The law will have to pass before petsmart shops will be allowed to sell plastic bags. Also, as far as I’m aware, they are not allowed to sell bags of dog food.
The pet shop law is just plain ugly and ridiculous. I am not sure how one would enforce this. If you bought something at the pet shop, like a dog food, and then you got sick and no longer had a pet, you might be in trouble. You could argue that it’s your fault because you’re still a responsible owner, but the law is already on the books.

I do know that if a pet store sold a dog food, that would be a violation, but in my opinion, a pet shop selling dog food is also selling a dog. A lot of pet shops are dog shops. As for cats, it’s a grey area, but the rules are there for another day.

I think the two things are different. A pet shop selling cat food (like the pet cafe here did in my town) is selling a cat. But a cat that has never had a pet is still a cat. And that is a grey area.
One of the reasons I’m concerned about pet shops selling cats is because of new guidelines under the pet food law. They’re not only making sure that they’re selling cat food that is certified by the USDA, but that the cat that’s being sold has never had a pet. That means the pet store isn’t selling any kind of pet food that could possibly be harmful to cats. I guess this is just a common sense thing.

But the FDA requires that pet food companies also put cat food that has never had a pet in it on the shelves.
